INFORMATION ABOUT THE BENISSA ASSOCIATION OF BUILDERS AND ASSOCIATED TRADES:
The Benissa Association of Builders and Associated Trades is made up of professionals from the construction sector and associated trades in the municipality of Benissa, who have come together to promote common aims. In the current climate, which is increasingly competitive and demanding, it is essential to closely analyse the way we and other professionals work since nowadays not all businesspeople have the specific training needed to undertake their activities.

You should be aware of the fact that if any of the people who are working in your home are not “fully legal workers”, you will be liable if they have an accident or there are other mishaps. Spanish legislation, in Article 1902 of the Civil Code, establishes that: “Whosever by act or omission causes damage to another is obligated to repair the damage caused where fault or negligence are present”. Article 42 of the Occupational Risk Prevention Act states that: “The failure of businesspeople to comply with their occupational risk prevention obligations can give rise to administrative liability and also criminal and civil liability, when applicable, for any damage that is caused by such non-compliance”.
This is why it is very important to make sure that you have hired a genuine professional, or a company with accredited experience, as it means that they are obliged to provide owners with liability cover for a wide range of areas:
- For 10 years: This covers damage caused to the building by flaws or defects affecting the foundations, supports, beams, structural supports, load-bearing walls, and other structural elements which directly impair the mechanical resistance and stability of the building.
- For 3 years:This covers damage caused to the building by flaws or defects in building elements or installations that do not comply with the habitability requirements established by law.
- For 1 year: The builder is liable for any damage caused by building flaws or defects which affect the building’s finishes and terminations.
- 15-year contractual liability: (regulated by the Civil Code) for non-compliance with specific clauses and pacts in the sales agreement or building contract.
- Professional civil liability: of Association members for acts or omissions committed by themselves or by their workers.
- Occupational risk prevention and health in the workplace: The failure to comply with these regulations can give rise to administrative sanctions, civil liability, and also criminal liability.
